7. Are you familiar with the breath machine used in the State of Texas? What are the breath machines' shortcomings?

In the State of Texas, all law enforcement agencies use a standard machine called the Intoxilyzer 5000. This is a highly expensive and complicated machine that has been used by state law enforcement agencies for years with mixed results. As a result, just because you failed a breath test does not mean that you have to plead guilty, as a majority of DWI defense attorneys might persuade you to do. At the Houston area DWI law firm of Tad Nelson and Associates, we know that, through experience and due research, a failed breath test does NOT mean that you are, or will be found, guilty. We have a thorough understanding of the policies, procedures, and philosophy behind the breath machines. It is this knowledge that we will put to work in fighting for your rights.

8. Are you skilled in the proper administration of Standardized Field Sobriety Tests? Do you have any specific Field Sobriety training?

The National Highway Traffic Safety Administration (NHTSA) has said that field sobriety tests must be administered in a "prescribed standardized manner" each and every time to ensure the tests are reliable. Therefore, it is imperative that your DWI lawyer understand the proper administration of these tests and is able to identify any deviations from the standardized manner that may affect the accuracy and reliability of the tests. It is also imperative that your DWI lawyer be highly trained in the procedures and measures involved in the training of law enforcement officials. A good DWI lawyer will have attended the same training courses as the police department has; and will also have had extensive experience not only in defending clients against these DWI tests, but will have many years of prosecution experience so that he will know both sides of this important subject.

9. Will you handle my license suspension case in addition to the DWI charge?

In addition to the criminal proceedings that follow an arrest for DWI, you will face an administrative license hearing that may result in your license being suspended for many months, or even years. Most DWI lawyers will bypass this hearing, or will not even request it because of lack of interest. A good DWI lawyer will always request this hearing in order to save your driving privileges. Even if you lose this hearing and your license is suspended, then it is still important to attend this hearing so that your DWI lawyer can gather information that will be vital to the success of your criminal trial.

12. What do you charge to handle a DWI case?

If you are looking for the lowest fee in defending your rights, you might want to consider the consequences of your actions. Would you really want the "low price leader" defending your freedom? Oftentimes, the low price that you pay for your DWI defense will end up costing you more in the end, due to the fact that a DWI verdict of guilty brings fines, lost wages, embarrassment and humiliation. Plus, a low price means that your low-cost DWI lawyer will be handling more cases, thus devoting less time to your specific defense.

Each DWI case is unique and requires a unique defense strategy tailored to your specific case. At Tad Nelson and Associates we offer you the proficiency, expertise and proven record of success necessary for the successful defense of your case.
